Of defaming and defamation

Four trustees of the Bombay Parsi Punchayet (BPP) have filed a complaint with the joint commissioner of police against BPP chairman Dinshaw Mehta for misappropriation of funds, cheating and criminal breach of trust. BPP trustees Arnavaz Mistry, Jimmy Mistry, Khojeste Mistree and Yazdi Desai filed the criminal complaint on November 13, 2013.
According to the DNA of November 14, 2013 Desai is quoted as stating, "We filed the case with the Economic Offences Wing (EOW) because there was criminal breach of trust on Mehta’s part.”

For his part Mehta has denied all the allegations and threatened to file a defamation case against his four co-trustees, states the Hindustan Times (HT) of November 15, 2013. "I will be submitting a defamation suit by Monday to claim Rs 5 crore as damages,” HT quoted Mehta as saying. "I will also file a civil and criminal complaint against them.”
The dispute revolves around the transfer of tenancy of a first floor commercial premises in Dady House in Bora Bazaar. Desai and Mehta quote different amounts for the money due from the tenant. Forty-five lakhs has reportedly been received by cheques by the BPP. Desai claims that the amount due was 65 lakhs and that part of this payment was allegedly made by cash.
DNA quotes BPP trustee Jimmy Mistry as stating, "We discussed the issue and after much thought, a complaint was filed. The investigation will bring out the truth.” The newspaper also quotes the joint commissioner of police (crime) Himanshu Roy stating that a complaint had been filed and that "I have ordered a preliminary inquiry into the matter.”
HT quoted the deputy commissioner of police (EOW) Balsingh Rajput saying that the complaint was still to reach him and that "we will conduct a preliminary inquiry and based on the investigations, will file a first information report.”
