Priests ban appeal filed

An appeal has been filed on April 29, 2010 by former Bombay Parsi Punchayet (BPP) trustee Jamsheed Kanga and Tata director Homi Khusrokhan against the order of Bombay High Court Judge V. M. Kanade dismissing the originating summons challenging the BPP’s right to ban two priests from performing religious ceremonies at Doongerwadi, Godavra Agiary and the S. F. Jokhi Agiary at Godrej Baug.
The suit is expected to come up before a divisional bench of the Bombay High Court once the Court reopens in June. The divisional bench can choose to admit or reject the appeal, refer it to a single judge or decide on the matter themselves. Notice has been served on the BPP trustees.
The appeal was drawn by advocate Yugandhara Khanwilkar, settled by senior advocate Iqbal Chagla and accepted by solicitors Dastur, Dadhich and Kalambi . The lawyers for the two petitioners are fighting the case without charging any fees.
