BPP Election Scheme

Scheme for the Election of Trustees of
the Funds and Immoveable Properties of
the Parsee Punchayet of Bombay.
(Originally Sanctioned by the High Court of Bombay in Suit No. 689 of 1906
on 18.6.1910, and amended by its orders of27.7.1931, 7.2.1935 and 2.4.1970).
(As sanctioned by Mrs. Justice Manohar and Mr. Justice Saraf by the order
dated 17th December, 1991 in Appeal No. 1137 of 1987 from order in
Miscellaneous Petition 137 of 1985).
Further amended by its orders dated 16.6.1992,23.10.1992,6.1.1993, 1.4.2005,
21.8.2006 and 5.4.2007 respectively.
INTERPRETATION
(a) The expression "Parsee" throughout this Scheme unless otherwise
qualified means a Parsee (including an Irani Parsee) whether male or
female of the age of 18 years or upwards professing the Zoroastrian
Faith and who shall, if so required by the Trustees, have filed in the
Office of the Bombay Parsee Punchayet an affidavit in such form as
may be prescribed or required by the Trustees that such male or
female, as the case may be, has not renounced the Zoroastrian faith,
whether by reason of marriage to a non-Zoroastrian spouse or
otherwise, and continues to profess the Zoroastrian faith.
(b) The word "Secretary" or "Secretaries" shall include the Chief Executive, Deputy Chief Executive, the Senior Executive or the

Deputy Executive or such other Officer as may from time to time be
designated by the Trustees as the case may be.
(c) "Effective Date" shall mean the date on which this Scheme shall
have been sanctioned by theHigh Court.

ANJUMAN COMMITTEE
1. A Committee to be called "THE ANJUMAN COMMITTEE" shall
be constituted and maintained in the manner hereinafter mentioned.
2. The Anjuman Committee shall consist of:
(a) All Parsees whose names are borne on the General Register;
(b) All Parsees whose names are borne on the Donor Register;
(c) Persons referred to in (a) above shall be called "The General
Members of the Anjuman Committee" and the persons
referred to in (b) above shall be called "The Donor Members
of the Anjuman Committee".
GENERAL REGISTER
3. The Trustees shall, continue to maintain the "General Register"
opened pursuant to the Orders of the High Court in O.S. Appeal No.
1137 of 1987. The General Register will comprise:
(a) All Parsis whose names are borne on the General Register as
on the Effective Date.
(b) Every Parsee whose name is not previously entered in the General Register and whose name does not appear on the Donor Register shall, on application to the Trustees in such form as may be from time to time be prescribed by the

Trustees (but which form will require a declaration -that the applicant professes the Zoroastrian faith) and on payment of a registration fee of Rs.I0/- or such other amount as the Trustees may from time to time determine, be entitled to have his/her name entered on the General Register and such entry shall be effective as of the date of receipt of his or her application .
(c) Any Parsee whose name appears on the General Register and who, at any time thereafter, becomes eligible to have his name entered on the Donor Register in accordance with the provisions in that behalf hereinafter contained shall, within the 180 days from the date of receipt of the donation by or on behalf of the Trustees, exercise his option to have his name deleted from the General Register and entered on the Donor Register.
