Toilet near Parsi well to go
Chief Justice Mohit Shah and Justice M. S. Sanklecha of the Bombay High Court (BHC) ordered on April 9, 2013 that the toilet block built near the 280-year-old Bhikha Behram Well should be demolished. Daily News and Analysis (DNA) reported on April 26, 2013 that members of the Parsi community who had long been asking for the removal of the toilet from near their holy well had taken the matter to the Supreme Court after the Bombay Municipal Corporation (BMC) gave permission to the Rotary Club of Bombay Sunrise in 1997 to build the offending structure. The Club is now defunct and the Supreme Court referred the matter back to the BHC.
Counsel for the BMC told the BHC during the hearing that when the permission had been given there was a dearth of toilet facilities in the area, but now there are at least five, so the toilet in question (which has never been used) was not required. Dr Viraf Kapadia, trustee of the Bhikha Behram Well feared that since there was a possibility that the sewage line could be connected to potable water due to the civic body’s negligence, "We went to court… it’s a sensitive issue.” Solicitors Burjor Antia and Homiar Vakil maintained it was unheard of to build a public toilet near a place of worship, DNA mentions.
